Air Iceland's travel- and contract conditions for passenger transfer.

REGARDING ELECTRONIC TICKETS ISSUED BY AIR ICELAND

NOTICE: If the passenger's journey involves an ultimate destination in a country other than the country of departure the Warshaw Convention may be applicable and the Convention governs and in most cases limits liability of carriers for death or personal injury and in respect of loss of or damage to baggage. If the carriage is domestic the Aviation Act applies regarding limitation on liability. See further "Notice of Liability Limitations".

CONDITIONS OF CONTRACT
1. As used in this contract "Warsaw Convention" means the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw, 12th October 1929, as that Convention was amended at The Hague, 28th September 1955, pursuant to Act No. 41/1949, as amended. "Aviation Act" means Aviation Act No. 60/1988, as amended.

2. Carriage pursuant to an electronic ticket issued by AIR ICELAND is subject to the rules and limitations relating to liability established by the Warsaw Convention unless such carriage is not "international carriage" as defined by that Convention. When the carriage is domestic it is subject to the rules and limitation relating to liability established by the Aviation Act.

3. To the extent not in conflict with the foregoing, carriage and other services performed by carrier are subject to: (I) applicable tariffs, (II) these conditions of carriage, (III) Baggage Check and Boarding Pass.

4. Any exclusion or limitation of carrier's liability shall apply to and be for the benefit of agents, servants and representatives of carrier and any person whose aircraft is used by carrier for carriage and its agents, servants and representatives.

5. Checked baggage will be delivered to bearer of the baggage check. In case of damage to baggage during international transportation, a complaint must be made in writing to carrier immediately upon discovery of damage and, at the latest, within 7 days from receipt; in case of delay, a complaint must be made within 21 days from the date the baggage was delivered. Notice periods regarding domestic carriage apply as provided in the Aviation Act.

6. An electronic ticket issued by AIR ICELAND is good for carriage for one year from date of issue, except as otherwise provided in carrier's tariffs, conditions of carriage, or related rules. The fare for the carriage under electronic ticket issued by AIR ICELAND is subject to change prior to commencement of carriage. Carrier may refuse transportation if the applicable fare has not been paid.

7. Carrier undertakes to use its best efforts to carry the passenger and baggage with reasonable dispatch. Times shown in timetables or elsewhere are not guaranteed and form no part of the contract of carriage. Carrier may without notice substitute alternate carriers or aircraft, if necessary. Schedules are subject to change without notice. Carrier assumes no responsibility for the passenger making flight connections. Compensation will not be payable to passengers if Carrier is forced to cancel or in any way change passengers holiday/flights due to force majeure which in this context is defined as government action or restraint, war, threat of war, riot, civil strike, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or any other event beyond Carrier's control. This rule applies also for international flights. Carrier is not responsible for any cost passenger has to bear due to the above mentioned reasons; this includes hotel, food and travel expenses.

The Icelandic Civil Aviation Administration

8. Passenger shall comply with Government travel requirements, present exit, entry or other required documents and arrive at the airport by time fixed by the carrier or, if no time is fixed, early enough to complete departure procedure.

9. No agent, servant or representative of carrier has authority to alter, modify or waive any provision of those conditions of contract.

Carrier reserves the right to refuse carriage to any person who has acquired a ticket in violation of applicable law or carrier's tariffs, rules or regulations.

Notice of Liability Limitations

International carriage:
Passengers on a journey with a destination in a country other than the country of origin are advised that the provisions of the Warsaw Convention may be applicable, e.g. regarding limitation on liability in the case of death, bodily harm or damage to baggage. Additional protection can usually be obtained by purchasing insurance from a private company. Such insurance is not affected by any limitation of the carrier's liability under the Warsaw Convention.

Domestic carriage:

1. Rules on bodily harm
In the event of an accident causing injury or death to passengers, the Carrier may exonerate himself wholly or partly from liability if he proves that the damage was caused by, or contributed to, by the negligence of the injured or deceased passenger. Also, the Carrier may exonerate himself wholly of partly from liability if he proves that the Carrier and the Carrier's employees have not been able to avoid the loss or have done everything to prevent the loss, recourse to such exoneration, however, only being permissible as regards damages in excess of the equivalent in currency of 100.000 SDR.

The Carrier is obligated to, without delay and in any event not later than 15 days after the identity of the passenger entitled to compensation has been established, make such advance payments as may be required to meet immediate economic needs on a basis proportional to the hardship suffered, such advance payment, however, in the event of death, never being less than the equivalent in currency of 15.000 SDR per passenger. Such advance payment does not constitute recognition of liability by the Carrier and may be offset against any subsequent sums to be paid on basis of the Carrier's liability and is reimbursable if it is proven that the person who received the advance payment caused, or contributed to, the damage by negligence or was not the person entitled to compensation.

2. Rules on Baggage Liability
Liability for loss, delay, or damage to baggage is limited as follows unless a higher value is declared in advance and additional charges are paid:

In the carriage of baggage, the liability of the carrier in the case of destructions, loss, damage or delay is limited to 1,000 SDR for each passenger unless the passenger has made, at the time when the cecked baggage was handed over to the carrier, a special declaration of interest in delivery at destination and has paid a supplementary sum if the case so requires.  In that case the carrier will be liable to pay a sum not exceeding the declared sum, unless it proves that the sum is greater than the passenger´s actual interest in delivery at destination.

Higher values fo individual items may be declared.

OVERBOOKING
Airline flights may be overbooked and there is a slight possibility that a seat will not be available on a flight for which a person has a confirmed reservation. A person denied boarding on a flight may be entitled to a compensatory payment.
